New regulations will replace previous Development Manual and provide clearer guidance to public and developers
Silver Spring, MD – The Montgomery County Planning Department, part of the Maryland-National Capital Park and Planning Commission, announces the release of the Planning Board draft of proposed administrative regulations for the recently enacted update of the County Code’s Chapter 50, Subdivision of Land. The Planning Board approved releasing the draft at its meeting on Thursday, March 2, 2017.
The new administrative regulations update Planning Department procedures related to the following: 1) processing development applications 2) Development Review Committee rules and procedures for agencies and applicants, and 3) a description of alternative application procedures.
The plan applications covered by the new regulations include pre-preliminary submissions, preliminary and subdivision plans, amendments to such plans, and record plats. Provisions from Chapter 59 of the County Code that cover sketch plans and site plans are also referenced in the regulations.

Most of the proposed administrative regulations are now part of the Planning Department’s Manual of Development Review Procedures, which will be replaced by the new regulations.
The purpose of the original manual and these proposed regulations continues to be to:
- Clearly explain the Planning Department’s overall regulatory review process for applicants, staff, residents and other interested parties.
- Clarify standards and procedures for submission of timely and relevant information by applicants.
- Provide for timely participation by public agencies in the review of applications.
- Provide for participation by interested parties so their views can be known by staff and the Planning Board before action is taken.
Next steps for the drafted regulations include:
-Planning Board public hearing
-Planning Board work session and adoption of regulations
-Transmittal of regulations to County Council
-Council review and approval by resolution.
